RULES FOR THE CONTEST

    1. Tata DOCOMO brand logos and music have been uploaded on create.tatadocomo.com. Participants can download the Tata DOCOMO brand logos and music from this link to take part in this Contest.
    2. Participants need to create original flash animations based on the brief provided on the website. No clarifications or additional details will be given to any participant on the brief and no communication in this regard will be entertained.
    3. The length of the flash animations created should be between 5- 10 seconds only.
    4. Participants need to upload their entry in the requisite software format (as specified in the brief) on the designated section of the website.  Request for submission of entries in any other manner or form will not be entertained.
    5. Participant needs to fill-up the entry form completely and correctly before uploading his entry. Incomplete forms will be summarily rejected and entries with false information (detected at any stage including after acceptance of the entry) will be summarily rejected and liable for penal action.
    6. An individual can submit as many entries that he wants. 
    7. Participant will have to sign-up an undertaking declaring that the work being uploaded by him is his own creative work and that he will indemnify Tata DOCOMO against any plagiarism claims, at any stage, on the work submitted by him.
    8. This Contest is open to individuals only. Corporate, Agencies, Animation Education Institutes, employees of TTSL, its business associates and their immediate family members are not allowed to take part in this Contest.
    9. Entries once submitted cannot be recalled or modified under any circumstances.  No communication in this regard will be entertained.
    10. Tata DOCOMO nominated jury will evaluate the entries and its decision on the winning entry, if any, will be final and binding.  
    11. The winning entry will become a copyright of Tata DOCOMO and the company will have all rights to use the winning entry (s) in whichever forums, media and frequency it deems appropriate, without any financial or any other obligation whatsoever. 
    12. The contest will be open from 23rd December - 26th December 2009 only. Late entries will not be accepted and no communication in this regard will be entertained.
    13. Winning Entry(s), if any, will get a cash award of INR 25,000 (subject to tax deduction as per the tax laws) and the winning entry (s) may be showcased by Tata DOCOMO, at its own expense, on Television, Online or any other media as per its sole discretion for its promoting its brand, products, business or any other objective it deems fit.
    14. Participant, with the winning entry, shall make himself available for various PR initiatives around the Contest at the appointed date, time and place as requested by Tata DOCOMO.

TERMS AND CONDITIONS OF THE CONTEST

    1. All entrants must agree to abide by the Terms and Conditions as described here.
    2. Participant acknowledges that all the copyrights rights and intellectual property rights of an entry, post its submission would entirely and solely vest with Tata DOCOMO only. By submitting the entry for the Contest, the participant agrees to assign and transfer all copyrights of the submitted entry to Tata DOCOMO without any consideration and compensation.  
    3. Any disputes with respect to the Contest shall be subject to the jurisdiction of courts of Delhi only.
    4. Participants are not permitted to submit entry on behalf of any other individual or entity.
    5. Entries must conform to decency guidelines. Any image deemed to contain content that depicts violence, racial, political, religious, and sexual or any other inflammatory, defamatory or objectionable material in an inappropriate manner will be disqualified and removed. Tata DOCOMO reserves the right to initiate legal action against such participants. Interpretation of what is, and is not, appropriate material is at the sole discretion of Tata DOCOMO.
    6. Neither Tata DOCOMO nor the associate sponsor (if any) for the Contest will be held responsible for late entries for any reason whatsoever. It is the sole responsibility of the participants to make reasonable allowances for upload time, bandwidth connectivity or Internet issues and plan their submissions accordingly.
    7. Entries will be judged on creative, artistic and technical merit within the scope of the Contest brief. The interpretation of these rules, the theme, creative, artistic or technical merit of the work and any other consideration made by the judges is at the sole discretion of the judges.
    8. Tata DOCOMO will have the sole right to reveal or not to reveal the evaluation process overall or the evaluation scores of specific entries
    9. Judges' decisions are final and no correspondence will be entertained in that regard.
    10. All Participants must provide accurate and reliable contact details. Tata DOCOMO will make all reasonable efforts to contact winners for a period of 7 calendar days after the completion of judging process. If a winner cannot be contacted within this period, for any reason whatsoever, then they can be disqualified at the sole discretion of Tata DOCOMO.
    11.  The Participant shall have no claim after an entry is submitted. Tata DOCOMO will have no liability to return any creative material submitted by any participant.
    12. The judges have sole discretion in the interpretation and enforcement of rules, including but not limited to suspension of categories, participants, entries.
    13. By entering the Contest the Participant warrants that he/she is the sole creator of the entry made by him/her and it is not copied from any third party creations nor does it infringe any third party's intellectual property rights and shall indemnify Tata DOCOMO and sponsor(s), if any, from any claims that may arise regarding ownership, or any other claims in respect thereof.
    14. Tata DOCOMO shall have the right to use all entered works, in any media for brand, products, business or any other objective as it may deem fit.  Tata DOCMO also reserves the right to display all entries on any medium (Online, TV etc) or vehicle it deems appropriate.
    15. The Participant shall indemnify Tata DOCOMO and sponsor(s) against any claims from any party and consequent losses, damages, compensation, whatsoever, that may arise from any use, including but not limited to, publication of entry materials submitted by the Participant as a part of, or in association with the Contest.
    16. The participant assumes all responsibility and costs for delivering the entry and other required information to Tata DOCOMO for evaluation in the Contest.
    17. There is no entry fee for participation in the Contest. Tata DOCOMO does not require any payment for entry of flash animations nor does Tata DOCOMO offer any form of payment, actual or implied, to any participants.
    18. There is no chance component in the selection of winning entries. Winning entries will be chosen solely on the skill exhibited by the entrants as determined solely by the jury appointed by Tata DOCOMO.
    19. Tata DOCOMO will take reasonable measures to ensure the security of entries and information supplied in them. In no event shall Tata DOCOMO be liable to any party, for damages / compensation arising out of any loss of entry and data supplied.
    20. Employees and relatives of Tata DOCOMO, sponsors, judges or any business associates of TTSL are not entitled to take part in the Contest.
    21. Tata DOCOMO reserves the right to suspend, shorten, modify or cancel the contest at its sole discretion.
    22. Tata DOCOMO will have no liability in case someone is not able to participate on account of his inability to download logos or music from the designated section of the website. No correspondence in this regard will be entertained.
    23. Participant should not deface or disparage the brand logo or music in any manner in creating their entry
    24. Tata DOCOMO is not responsible for participant not being able understand the brief or for his interpretation of the same. No correspondence in this regard will be entertained.
    25. Tata DOCOMO is not responsible for participant not being able to upload his work due to any reason whatsoever including temporary problems with the designated entry uploading section on the Tata DOCOMO website.
    26. Tata DOCMO is not responsible if the uploaded work does not play and hence the entry is not part of the list for evaluation by the jury.
    27. Private correspondence or canvassing in any form will lead to rejection of the entry submitted by the participant.
    28. Tata DOCOMO can get general public to vote on the various entries submitted by the participants at its sole discretion. Organized voting will lead to summary disqualification of the participant/entry.
    29. The participant cannot post same or similar entry as submitted for the Contest at any other blog/forum or any site .
    30. The names of winners will be displayed on the Tata DOCOMO website. The same will also be communicated individually to the winners via e-mail and/or other modes.
    31. Tata DOCOMO will not be held responsible if the communication pertaining to the winning entries doesn't reach intended contestants for any of the following reasons as mentioned:-
      1. Incorrect e-mail address given at the time of submitting entry
      2. Inbox of the recipient being full / having insufficient space
      3. Bandwidth problem of the mailbox / server or the host
      4. Time lapse
      5. Any other reason, technical or otherwise,  beyond the control of Tata DOCOMO
    32. The Contest is open for Indian Citizens only.
    33. Tata DOCOMO reserves the right to modify, add, or delete any terms and conditions or participation mechanics of the contest at any point of time on its sole discretion and without any prior information to anyone.
    34. All questions / queries including but not limited to claiming of prize by the winners will be responded to within 30 days of the announcement of the winners. No correspondence in this regard shall be entertained thereafter.
    35. The Contest is open from 23rd December 2009 until 26th December 2009
